Scope and contracting party

These terms apply to every purchase of tickets, table reservations and advance drink orders through www.onyx-graz.at, and to participation in the promoter programme.

The contracting party is Hoiss GmbH, Laßnitzthal 384/5, 8200 Gleisdorf, Austria, company register no. FN 680235 x, which operates the ONYX club in Graz (referred to as ONYX). Deviating terms do not apply. Nothing in these terms limits the statutory rights of consumers under the Austrian Consumer Protection Act.

Formation of the contract

The presentation of tickets and tables on the website is not a binding offer. By completing payment you make an offer, which ONYX accepts with the order confirmation sent by email; this forms the contract.

You receive your tickets as a PDF with a QR code by email and can retrieve them at any time via the link in the confirmation. During payment the chosen seats are reserved for you briefly; if payment is not completed they are released again.

The contract language is German. The English version of these terms is for information only.

Tickets

Tickets are personalised. When buying, the first and last name of the person who will use each ticket must be given; that person must show official photo ID at the door.

Each ticket carries its own QR code and admits one person. On first entry you receive a wristband that lets you re-enter the club the same night. The QR code is invalidated on its first scan; keep your ticket private and do not pass it on.

Commercial resale of tickets is prohibited. The price is the one valid at the time of purchase; later price changes give no right to a refund or additional payment.

Prices and payment

All prices are in euros and include 20 % VAT. The total price is shown before you complete the order; no additional fees apply.

Payment is made through our payment provider using the payment methods offered there. Tickets are issued only once payment has been received in full. You receive the invoice by email after payment.

No right of withdrawal

For leisure services tied to a specific date there is no statutory right of withdrawal (§ 18(1)(10) of the Austrian Distance and Off-Premises Transactions Act). Tickets therefore cannot be withdrawn from. The same applies to table reservations and the drinks ordered in advance with them.

Please check the date, quantity and names before you buy.

Cancellation and postponement

If ONYX cancels an event, we refund the full ticket price and, for table reservations, the drinks ordered in advance, automatically to the payment method originally used. You are informed by email and need do nothing.

If an event is postponed, your ticket is valid for the new date. If you cannot attend the new date, we refund the ticket price on request to office@onyx-graz.at within 14 days of the postponement being announced.

No further claims exist, for example for travel or accommodation costs. Changes to the programme, such as the line-up, give no right to a refund.

Table reservations and minimum spend

A table reservation covers the table for the stated party size on a specific night, and admission for those people.

Every table carries a minimum spend, shown on the booking page. It is met by ordering drinks in advance, which are paid for at booking. You pay the value of the drinks ordered, even where it exceeds the minimum spend. Further drinks can be ordered in the club at the prices applying there.

The table is held for you from doors opening. If the party does not arrive, or arrives significantly late, ONYX may give the table to others; in that case there is no right to a refund of the reservation amount or of the drinks ordered in advance.

Table reservations and orders of spirits are available only to people aged 18 or over.

Entry, house rules and protection of minors

Every event has a minimum age of 16 or 18, stated on the event page. When buying, you confirm that every person you buy a ticket for has reached that age. Age is checked at the door against official photo ID. At events for ages 16 and over, no spirits and no mixed drinks containing spirits are served to anyone under 18.

The house rules apply and you accept them with your purchase. Anyone who does not meet the age requirement, breaches the house rules, or is visibly heavily intoxicated or under the influence of drugs may be refused entry or removed from the club. The ticket price is not refunded in that case.

Promoter programme and Onyx Coins

People aged 18 or over with an account can take part in the promoter programme. Promoters receive a personal guest-list link for each event. For every ticket sold and paid for through it, they are credited Onyx Coins at the rate valid at the time of purchase.

Coins are not money. They have no euro value, cannot be paid out or transferred, and cannot be redeemed for tickets or table reservations, only for drink vouchers from the range offered in the promoter area. Coins expire twelve months after being credited, a drink voucher six months after being issued; the coins spent on it are not returned on expiry. If an event is cancelled, coins already credited are kept.

ONYX may change the number of coins per ticket and the coin prices of drinks with effect for the future, and may end the programme with reasonable notice. Coins already credited remain redeemable until they expire.

Promoters act independently and in their own name. Misleading advertising and unsolicited bulk messages are prohibited and lead to exclusion from the programme; coins obtained through abuse are forfeited.

Liability

ONYX is liable for damage only in cases of intent or gross negligence. This does not apply to personal injury or to claims under the Product Liability Act.

For items brought into the club, ONYX is liable within the limits of the statutory provisions. ONYX is not liable if a ticket you passed on, or that was accessible to others, is redeemed before you use it.

The website may be temporarily unavailable due to maintenance or faults; there is no entitlement to uninterrupted availability.

Governing law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers resident in another EU state, the mandatory consumer protection provisions of their state of residence remain unaffected.

Claims against consumers are governed by § 14 of the Consumer Protection Act. For claims against businesses, the competent court in Graz has jurisdiction.

Should any provision of these terms be invalid, the remaining provisions remain unaffected.
